• Client: any professional or natural person with legal capacity within the meaning of Articles 1123 et seq. of the French Civil Code, or any legal entity, who visits the Site and uses the Services covered by these general terms and conditions.
• Services: Mediads provides Clients with a service that, on the one hand, enables them to generate revenue through branded content or partnerships and, on the other hand, improves the performance of media and influencer creative work for brands.
• Content: All elements constituting the information present on the Site, in particular text, images, and videos.
• Client Information: Hereinafter referred to as “Information,” corresponding to all personal data that may be held by https://www.mediads.io for the management of your account, customer relationship management, and for analysis and statistical purposes.
• User: Any internet user connecting to and using the aforementioned site.

The Client may not in any way reuse, transfer, or exploit for their own benefit all or part of the elements or works of the Site.

Use of the website https://www.mediads.io implies full and complete acceptance of the general terms of use described below. These terms of use may be modified or supplemented at any time; users of the website https://www.mediads.io are therefore invited to review them regularly.

This website is normally accessible to users at all times. However, Mediads may decide to interrupt access for technical maintenance purposes, in which case it will endeavor to inform users in advance of the dates and times of the intervention.

The objective is to provide a service that ensures the best possible accessibility rate. The hosting provider ensures the continuity of its service 24 hours a day, every day of the year. It nevertheless reserves the right to interrupt the hosting service for the shortest possible periods, in particular for maintenance purposes, to improve its infrastructure, in the event of infrastructure failure, or if the Services generate traffic deemed abnormal.

Mediads and the hosting provider cannot be held liable in the event of a malfunction of the Internet network, telephone lines, or computer and telephone equipment, in particular due to network congestion preventing access to the server.

5. Intellectual property and infringement

Mediads owns the intellectual property rights and holds the usage rights to all elements accessible on the website, in particular the text, images, graphics, logos, videos, icons, and sounds.

Any reproduction, representation, modification, publication, or adaptation of all or part of the elements of the site, by any means or process whatsoever, is prohibited without the prior written authorization of: https://www.mediads.io.

Any unauthorized use of the site or of any of the elements it contains will be considered an act of infringement and prosecuted in accordance with the provisions of Articles L.335-2 et seq. of the French Intellectual Property Code.

6. Limitations of liability

Mediads acts as the publisher of the website https://www.mediads.io and is responsible for the quality and accuracy of the Content it publishes.

Mediads cannot be held liable for direct or indirect damage caused to the user’s equipment when accessing the website https://www.mediads.io, resulting either from the use of equipment that does not meet the specifications set out in Section 4, or from the occurrence of a bug or incompatibility.

Mediads also cannot be held liable for indirect damages (such as, for example, loss of business or loss of opportunity) resulting from the use of the website https://www.mediads.io.

Interactive areas (the ability to ask questions in the contact section) are available to users. Mediads reserves the right to remove, without prior notice, any content posted in this area that would violate the legislation applicable in France, in particular the provisions relating to data protection. 7. Personal data management

The Client is informed of the regulations concerning marketing communications, the French Law of June 21, 2004 on confidence in the digital economy, the French Data Protection Act of August 6, 2004, as well as the General Data Protection Regulation (GDPR: No. 2016-679).

7.1 Parties responsible for the collection of personal data

For Personal Data collected in connection with the creation of the User’s personal account and their browsing of the Site, the party responsible for processing Personal Data is represented by its DPO.

As the controller of the data it collects, Mediads undertakes to comply with the legal provisions in force. It is in particular the Client’s responsibility to establish the purposes of its data processing, to provide its prospects and clients, upon collection of their consent, with complete information about the processing of their personal data, and to maintain an accurate record of processing activities.

Whenever Mediads processes Personal Data, Mediads takes all reasonable measures to ensure the accuracy and relevance of the Personal Data with regard to the purposes for which Mediads processes it.

7.2 Purposes of the data collected

Mediads may process all or part of the data:

• to enable browsing of the Site and the management and traceability of the services ordered by the user: connection and Site usage data, billing, order history, etc.
• to prevent and combat computer fraud (spamming, hacking, etc.): computer equipment used for browsing, IP address, password (hashed)
• to improve browsing on the Site: connection and usage data
• to conduct optional satisfaction surveys on https://www.mediads.io: email address

7.3 Right of access, rectification, and objection

As soon as Mediads becomes aware of a User’s death, and in the absence of instructions from them, Mediads undertakes to destroy their data, unless its retention proves necessary for evidentiary purposes or to comply with a legal obligation.

If a User wishes to know how Mediads uses their Personal Data, to request its rectification, or to object to its processing, the User may contact Mediads in writing at the following address:

In this case, the User must indicate the Personal Data they would like Mediads to correct, update, or delete, identifying themselves precisely with a copy of an identity document (identity card or passport).

Requests for the deletion of Personal Data will be subject to the obligations imposed on Mediads by law, in particular with regard to the retention or archiving of documents. Finally, Users of Mediads may file a complaint with the supervisory authorities, in particular the CNIL (https://www.cnil.fr/fr/plaintes).

7.4 Non-disclosure of personal data

Mediads refrains from processing, hosting, or transferring the Information collected about its Clients to a country located outside the European Union or recognized as “non-adequate” by the European Commission without informing the client in advance. However, https://www.mediads.io remains free to choose its technical and commercial subcontractors, provided that they present sufficient guarantees with regard to the requirements of the General Data Protection Regulation (GDPR: No. 2016-679).

Mediads undertakes to take all necessary precautions to preserve the security of the Information and, in particular, to ensure that it is not disclosed to unauthorized persons. However, if an incident affecting the integrity or confidentiality of the Client’s Information is brought to the attention of Mediads, Mediads must inform the Client as soon as possible and communicate the corrective measures taken. Furthermore, Mediads does not collect any “sensitive data.”

The User’s Personal Data may be processed by subsidiaries of Mediads and by subcontractors (service providers), exclusively in order to fulfill the purposes of this policy.

7.5 Types of data collected

Mediads also collects information that helps improve the user experience and provide contextualized advice:

  Function, recipient, and retention period: Used to identify individual clients behind a shared IP address and to apply security settings on a per-client basis. This cookie expires when the browser is closed.

Security

To ensure the security and confidentiality of Personal Data and Personal Health Data, Mediads uses networks protected by standard measures such as firewalls, pseudonymization, encryption, and passwords.

9. Hyperlinks, “cookies,” and internet tags

9.1. “Cookies”

This file includes information such as the User’s domain name, the User’s Internet service provider, the User’s operating system, and the date and time of access. Mediads may process the User’s information regarding their visit to the Site, such as the pages viewed and the searches performed. This information enables Mediads to improve the content of the Site and the User’s browsing experience.

As Cookies facilitate browsing and/or the provision of the services offered by the Site, the User may configure their browser to allow them to decide whether or not to accept Cookies, so that Cookies are stored on the device or, on the contrary, rejected, either systematically or according to their sender. Where applicable, Mediads declines all liability for the consequences of degraded operation of the Site and of any services offered by Mediads, resulting from (i) the User’s refusal of Cookies or (ii) the impossibility for Mediads to store or access the Cookies necessary for their operation as a result of the User’s choice. For the management of Cookies and the User’s choices, each browser is configured differently. The configuration is described in the browser’s help menu, which will explain how the User can modify their Cookie preferences.

At any time, the User may choose to express and modify their Cookie preferences. Mediads may also use the services of external providers to help it collect and process the information described in this section.

Finally, by clicking on the icons dedicated to the social networks Twitter, Facebook, LinkedIn, and Google Plus appearing on the Site of https://www.mediads.io or in its mobile application, and if the User has accepted the placement of cookies by continuing to browse the Website or the mobile application of Mediads, Twitter, Facebook, LinkedIn, and Google Plus may also place cookies on your devices (computer, tablet, mobile phone).

These types of cookies are only placed on your devices if you consent to them by continuing to browse the Website or the mobile application of https://www.mediads.io. At any time, the User may nevertheless withdraw their consent to Mediads placing this type of cookie.

9.2. Internet tags

Mediads may occasionally use internet tags (also known as “tags,” action tags, single-pixel GIFs, clear GIFs, invisible GIFs, and one-to-one GIFs) and deploy them through a web analytics specialist partner that may be located (and may therefore store the corresponding information, including the User’s IP address) in a foreign country.

This technology enables Mediads to assess visitors’ responses to the Site and the effectiveness of its actions (for example, the number of times a page is opened and the information viewed), as well as the User’s use of the Site.

10. Governing law and jurisdiction

Any dispute relating to the use of the website https://www.mediads.io is subject to French law.

Except where prohibited by law, exclusive jurisdiction is granted to the competent courts of PARIS, France.

11. Intellectual property

The company Mediads, its partners, and its clients own or hold the usage rights to all intellectual property rights relating to the content distributed or displayed on the website www.mediads.io. It is expressly recalled that, in accordance with the provisions of the French Intellectual Property Code, only reasonable use for private purposes of the elements covered by such rights is authorized.
